PlayFetish.com is an online platform for meetings between physical persons. PlayFetish.com allows registered users (hereinafter, "Users" or "you") to upload content (profile description, photos, comments, etc.) to the PlayFetish.com website and to communicate with other registered users via chat and messaging services.
Registration on PlayFetish.com is reserved for adults over the age of 18. By registering on PlayFetish.com, entering your date of birth and validating your age, you confirm that you are 18 years of age or older.
You are informed that engaging in any activity of solicitation, prostitution, or procuring through the PlayFetish.com website is strictly prohibited.
The service accessible at the URL www.PlayFetish.com (hereinafter "PlayFetish.com") is offered by the company Deus Communication (hereinafter "Deus Communication") to the Users of PlayFetish.com. (see legal notices)
By checking the "I accept" box, you confirm that you accept without reservation these general terms of use for the PlayFetish.com service ("PlayFetish.com ToS" or "ToS") and the Personal Data Protection Charter. Acceptance of these ToS and the Personal Data Protection Charter formalizes the conclusion of a contract between you and the company Deus Communication, for the purpose of using the PlayFetish.com service. If you do not accept the conditions of the PlayFetish.com ToS and/or the Personal Data Protection Charter, you cannot use our services.
This version of the PlayFetish.com ToS comes into force as of January 27, 2026.
We reserve the right to modify these ToS at any time. The new version will come into force 15 days after being posted online. A message informing you of the modification to the ToS will be displayed on the home page and sent to registered Users. Continued use of PlayFetish.com after this notification constitutes your acceptance of the new version of the ToS. If you refuse the new version of the ToS, you will no longer be able to use our services after this 15-day period.
4.1 Registration. Registration for our services and their use are subject to the following cumulative conditions: i - you must be at least 18 years old on the date of registration on the PlayFetish.com site,
ii – your age (>18 years) has been validated,
iii – you have read and accept the terms of these ToS and the Personal Data Protection Charter,
iv - your registration must be confirmed. To do this, you must provide PlayFetish.com with your email address or mobile phone number. PlayFetish.com will send you a validation code by email or SMS. This validation code will allow you to validate your registration on the PlayFetish.com site.
4.2 Age Validation; Profile Certification. When you register on PlayFetish.com, your age must be validated to confirm that you are over 18 years old.
You can also certify your profile to confirm your majority and the authenticity of your profile. Deus Communication also reserves the right to ask you to certify your profile at any time to confirm the veracity of the information entered in your account. We reserve the right to suspend or block your access to PlayFetish.com if you refuse to certify your profile following a request from Deus Communication.
The age validation or profile certification procedure is carried out by Yoti (or any other site offering similar services). This procedure is secure and anonymous. Yoti is not aware of the site for which age validation or profile certification is requested. When you connect to Yoti to validate your age or certify your profile, you must accept their own terms of use and personal data protection policy.
This contract comes into force when you have completed the registration procedure on PlayFetish.com, for an indefinite period.
We may, and you may, terminate it at any time under the following conditions:
- upon request from you to close your User account, according to the terms described in the Personal Data Protection Charter;
- in case of use of your account in violation of these ToS, and in case of attempted fraud or any other offense. In this case, we will send you a notification message accessible via your PlayFetish.com account asking you to remedy the violations of the ToS within 48 hours. In the absence of correction within this period, we then reserve the right to close your User account without further notice. Any account closure initiated by Deus Communication will be carried out without prejudice to compensation for the entire damage possibly suffered by Deus Communication due to your actions on PlayFetish.com.
In addition, this contract will end automatically:
- in case of refusal on your part of any new version of the ToS, as specified in article 3 hereof;
- if you have not logged into PlayFetish.com for 24 months.
Deus Communication may develop its services available on PlayFetish.com or the functionalities related to the services at any time. Users will be informed of these developments as soon as they are posted on PlayFetish.com.
7.1 Free Services. Registration for the PlayFetish.com service is free. It allows access to certain basic functionalities, namely:
• Creating your user account (profile),
• Consulting the profiles of other Users on PlayFetish.com,
• Chatting with other Users.
7.2 Paid Services. The use of certain services available on PlayFetish.com is paid. Paid services give you access to the following services in particular:
• Unlimited consultation of User photos and videos,
• Your photos/videos visible to all Users,
• Unlimited consultation of testimonials,
• Your testimonials visible to everyone,
This list may evolve. The full list of paid services is available on the "Premium" page.
The price list and payment terms are as follows:

Payment can be made by credit card or bank transfer. Once the payment is validated, you will be redirected to a payment confirmation page and you will receive an email from PlayFetish.com acknowledging receipt of the payment. The payment is not automatically renewed.
We reserve the right to modify prices at any time, subject to 15 days' notice. A message informing you of the new price list will be displayed on the home page and sent to registered Users. Subscription to paid services after the price modification constitutes your acceptance of the new prices. If you refuse the new prices, you will no longer be able to use the paid services after this 15-day period.
In the context of using our services, you undertake not only to comply with the stipulations described in these ToS and the Personal Data Protection Charter, but also with the laws in force, and to respect the rights of third parties. You undertake in particular to use our services only for purposes consistent with those described in these ToS and to use your password and identifier according to their strict purpose of authentication for the service.
PlayFetish.com is a service exclusively reserved for adults over the age of 18.
You undertake to:
- not connect to the PlayFetish.com site in the presence of minors,
- not transmit to minors all or part of the content of the PlayFetish.com site,
- not encourage minors to connect to the PlayFetish.com site.
You undertake to set up a computer locking and/or filtering system or any other means preventing access by minors to PlayFetish.com services from your computer or any other terminal (mobile phone and tablet). In addition, we recommend equipping your computer with parental control software securing access from your station to websites with adult content.
During your registration on PlayFetish.com and throughout the period of use of our services, you guarantee that the data you communicate is accurate and consistent with reality. You will have a personal identifier (login) and a password, strictly personal and confidential. You must not communicate or share them with third parties.
The use of PlayFetish.com implies the commitment of Users to respect the following principles:
- post information and other content that is truthful, honest, and fair,
- display a photo of oneself on one's profile,
- always be polite and correct towards other Users, never threaten or harass them,
- respect the privacy of other Users and the confidentiality of correspondence. Do not disclose or distribute the content of exchanges between Users,
- do not disclose or upload personal information (such as last name, email address, postal address, phone number), photos and videos of other Users or third parties,
- do not distribute illegal remarks or content, and in particular any content of a defamatory, abusive, insulting, offensive, discriminatory, violent, xenophobic, child pornographic nature, promoting terrorism or inciting racial hatred, bestiality, or pedophilia,
- do not upload photos, videos or personal information representing or concerning minors,
- do not use our services for commercial or advertising purposes,
- do not use our services to offer, solicit, or promote paid services or services with financial consideration; solicitation, prostitution, and procuring being formally prohibited on PlayFetish.com.
- do not use our services to build User files and send them unsolicited mass emails or mail (spamming),
- do not upload, communicate or send, via the PlayFetish.com site: (i) content that includes links pointing to illegal or offensive third-party websites or to websites that would be incompatible with the purpose of the PlayFetish.com service, or (ii) any content that could disrupt the normal use of PlayFetish.com,
- do not use software, devices or manual processes: (i) to copy our web pages or to record or collect information on these pages without the prior express written consent of Deus Communication or (ii) for the purpose of disrupting or attempting to disrupt the proper functioning of our service.
In case of breach of one or more of these obligations, Deus Communication reserves the right to (i) delete any information, photo or content that does not comply with these ToS and (ii) definitively exclude the offending User from the PlayFetish.com site and close their personal account.
In addition, non-compliance with certain particularly sensitive obligations, namely those relating to procuring, pedophilia, or bestiality, will result in the definitive removal of the User from our services and may lead to a complaint being filed with law enforcement.
Deus Communication is committed to protecting the personal information provided by Users of PlayFetish.com. The conditions relating to the protection of your personal data are described in the Personal Data Protection Charter which you must accept during your registration to be able to use the PlayFetish.com service. The Personal Data Protection Charter is an integral part of the ToS.
14.1 Content of the PlayFetish.com site. The content of the PlayFetish.com service, in particular its structure, design, text, images and graphic elements that compose it as well as the HTML meta-tags for search engine optimization, are the exclusive property of Deus Communication, with the exception of content provided by Users on their dedicated web pages, or by third parties. These elements of content, whether they are the property of Deus Communication or third parties, are protected by the Intellectual Property Code and by all other national or international laws in force on intellectual property.
You are authorized to represent the pages of the PlayFetish.com site on your screen for temporary consultation purposes only. Any reproduction, distribution or use of all or part of the site's content in any form whatsoever, without the prior express authorization of Deus Communication, is prohibited and would constitute infringement, sanctioned by articles L.335-2 and following of the Intellectual Property Code.
You are prohibited from carrying out extractions by temporary or permanent transfer, or from using, by making available to the public, all or a substantial part of the web pages of the PlayFetish.com site and other databases visible on the PlayFetish.com site for commercial, statistical or other purposes.
You are also prohibited from any repeated and systematic extraction or use of all or part of the information visible on the PlayFetish.com site, when such an operation clearly exceeds normal and private use of PlayFetish.com. Finally, you are prohibited from any exploitation, commercialization or distribution of any constituent element of PlayFetish.com, including in particular User pages visible on the PlayFetish.com site and any other database.
14.2 License to use content provided by Users. Deus Communication may be required to classify and highlight certain photos and videos to make its services attractive. The content you upload may be selected according to internal evaluation criteria and thus be highlighted on the different pages of the PlayFetish.com site and the sites of the Deus Communication group. It is specified that these highlights are not remunerated.
You grant us a right to use the content elements (text, photos, videos, etc.) that you upload to PlayFetish.com. This license to use such content is transferable, non-exclusive, free of charge, granted without geographical limitation and for the duration of your registration on PlayFetish.com. You grant us the right to grant sub-licenses for the use, exploitation and disclosure of this content for exploitation on any existing or future media of the Deus Communication group. This use license will remain in force until the definitive closure of your account on PlayFetish.com.
In this respect, you notably grant Deus Communication, for the needs of its activities, including for all sites and services on the internet operated by the Deus Communication group, but also for advertising and/or promotional purposes, the right to (or have) fix, reproduce, record, represent, broadcast, distribute, translate into all languages and adapt, notably by integrating new elements (logo, distinctive sign, etc.) and reformat all or part of your content, on any media whatsoever, known or unknown to date, and by any processes known or unknown to date.
14.3 Indemnification. You guarantee that you hold the intellectual property rights to the content you upload to PlayFetish.com, or are duly authorized to do so by the right holders. Furthermore, in case of a plurality of persons in a photograph or video that you publish on the PlayFetish.com site, you guarantee that you are duly authorized by these persons to distribute this photograph or video on PlayFetish.com.
You agree to defend and indemnify Deus Communication (including legal fees) against any demand or claim made by a third party, caused by or resulting from a violation by you of these ToS, including in case of infringement, defamation or violation by you of any applicable regulations in the context of using the PlayFetish.com service.
Deus Communication cannot be held responsible for any damage resulting from the use of the service or the connection between you and any other User. In this regard, Deus Communication cannot be held responsible for any damage, direct and/or indirect, caused by Users during physical meetings between Users.
Deus Communication cannot be held responsible concerning the connection with Yoti (or any other age validation service), your use of this third-party service, as well as the result of the age validation. Only the terms of use of Yoti (or any other age validation service) are applicable to the age validation procedure.
PlayFetish.com hosts web pages on which Users can upload content and offers chat and messaging services through which Users can exchange with each other. We do not exercise any control over the quality, reliability, accuracy, relevance or completeness of the content uploaded by Users or over the identity of Users.
Deus Communication cannot be held responsible for the content uploaded by Users, as well as false information or statements made by Users. Users are solely responsible for the content (descriptions, photos, comments, etc.) they publish on PlayFetish.com, Deus Communication only having a role as host of the content uploaded to PlayFetish.com by Users.
Deus Communication does not directly control the legal capacity (age) of Users, their date of birth being entered during their registration on PlayFetish.com. An age validation procedure (majority) is set up upon registration on PlayFetish.com. This procedure may be modified in the future, taking into account regulatory changes and techniques. Deus Communication will close any User account in the event that it becomes aware of a false date of birth declaration and/or a fraudulent age validation.
Deus Communication cannot be held responsible for any loss or alteration of data, any loss of opportunity, time, or any indirect damage, whatever the cause.
Deus Communication is not responsible in case of identity theft of a User. In the event that you have reason to believe that an unauthorized person is using your identification data or your account, you must immediately inform Deus Communication at [email protected] indicating your nickname and the name of the site (PlayFetish.com).
PlayFetish.com may include hypertext links to third-party websites. Deus Communication can in no way be held responsible for any damage, direct and/or indirect, which could result from the use of content, data or information of any kind, accessible from hypertext links published on PlayFetish.com. Deus Communication also cannot be held responsible for any damage, direct and/or indirect, which could result from the use of information appearing on third-party sites accessible from PlayFetish.com, including content uploaded by Users (photos, comments, etc.), or in downloadable files accessible on these third-party sites from hypertext links published on the PlayFetish.com site.
This site and the services offered by PlayFetish.com are provided as is. We exclude, within the limits permitted by law, all warranties, including any warranty of non-infringement. We do not guarantee that the operation of our services will be uninterrupted, error-free or secure.
Deus Communication does not moderate the content uploaded by Users. We may, however, be required to question Users about content or to delete certain content (photos, videos, etc.) following notification from a User, as specified below, and if this content appears to be contrary to the ToS and/or the law.
In the event that you become aware of content appearing on PlayFetish.com showing information appearing to be false, offensive, inappropriate or illegal, such as notably described in articles 9 to 11, we ask you to notify us immediately so that we can disable it, by sending us a message via the Contact section of the PlayFetish.com site or an email with your nickname, the name of the site, the link to the content in question, the reason why this content should be deleted or blocked and its justification, to [email protected].
In the event that you become aware of a minor User who has registered on PlayFetish.com by falsifying their date of birth, or the age validation procedure, we ask you to notify us immediately so that we can block the account, by sending us a message via the Contact section of the PlayFetish.com site or an email with your nickname, the name of the site, the nickname of the suspected minor User and the justification, to [email protected].
In accordance with articles L.221-18 and following of the Consumer Code, you have a period of fourteen days from the day of subscription to paid services to exercise your right of withdrawal, without penalty and without reason, by completing the withdrawal form (downloadable here), or by means of an unambiguous statement, sent by post to Deus Communication, 47 rue Marcel Dassault - 92514 Boulogne Billancourt, or by email to [email protected].
Withdrawal requests received after the expiration of the fourteen-day withdrawal period will not be taken into account. Furthermore, only requests related to the exercise of the right of withdrawal will be processed from this email address.
In accordance with article L.221-25 of the Consumer Code, you can however start using the paid services immediately, without waiting for the end of the withdrawal period, by clicking on the button on the payment confirmation page.
If you do not wish to use the paid services immediately, you can leave PlayFetish.com after validating your payment and wait for the fourteen-day period to expire. If you log into your account and use the paid services before this period expires, this first connection from the purchase of paid services constitutes use of the paid services.
Immediate use of paid services does not deprive you of your right of withdrawal, which continues to run until the expiration of the fourteen-day period. However, if you have started using the paid services before the end of the withdrawal period, you must pay the amount corresponding to the number of days of use of the paid services. In this case, Deus Communication will refund the difference between the amount you paid, minus the amount corresponding to the number of days elapsed between the day of the first use of the paid services and that of receipt by Deus Communication of your withdrawal request. Any day started is due in full.
The refund will take place within fourteen days from the date on which Deus Communication was informed of your decision to withdraw, by the same means of payment as the one you used.
Deus Communication cannot be held responsible for any breach of its obligations under the ToS caused by events beyond our control, the act of a third party and/or resulting from a case of force majeure. Cases of force majeure will include notably, in addition to cases recognized by case law, all natural disasters, all acts of war, attacks on public order, epidemics, fires, floods and other disasters, all government acts, (including delays in issuing certificates or export authorization), all strikes, lockouts, as well as all electrical and technical problems external to the parties and preventing communications.
If one or more stipulations of the ToS or the Personal Data Protection Charter were declared null in application of a law, a regulation or following a definitive decision by a jurisdiction or a competent authority, the other stipulations will keep all their force and scope, to the extent permitted by law, regulation or the applicable decision.
The ToS and the Personal Data Protection Charter represent the entire agreement between the parties concerning the provision of services offered by Deus Communication.
These ToS, as well as the Personal Data Protection Charter which is incorporated by reference, are subject to French law.
In case of disagreement or difficulties between the parties concerning the execution of the ToS, including the Personal Data Protection Charter, the parties will initially attempt to resolve their dispute amicably.
In accordance with the provisions of articles L.612-1 and following of the Consumer Code concerning the mediation of consumer disputes, the User has the right to resort to a consumer mediator with a view to the amicable resolution of the dispute which opposes them to the company Deus Communication. The company Deus Communication adheres to the mediation service offered by MED CONSO DEV. The User can also register their dispute on the dispute resolution platform proposed by the European Commission, at consumer-redress.ec.europa.eu. The European Commission will then transfer the User's complaint to the competent national mediators.
The mediation service can be seized by the User under the following reservations: the User must have attempted, beforehand, to resolve the dispute directly with the company Deus Communication; the request must not be clearly unfounded or abusive; the dispute must not have been previously examined or be under examination by another mediator or by a court; the User must not have introduced their request to the mediator within a period greater than one year from their written complaint to the company Deus Communication; the dispute falls within the mediator's field of competence.
FAILING AN AMICABLE AGREEMENT, ANY DISPUTE RELATING TO THESE TOS WILL BE SUBMITTED TO THE FRENCH COURTS WHICH WILL HAVE EXCLUSIVE JURISDICTION TO RULE ON ALL DISPUTES LIKELY TO ARISE BETWEEN THE PARTIES, RELATING TO THE EXECUTION OF THE TOS, OR THE PERSONAL DATA PROTECTION CHARTER, EVEN IN CASE OF SUMMARY PROCEEDINGS, BY REQUEST, OR THIRD-PARTY COMPLAINT.

The Charter is applicable to all Users registered on PlayFetish.com.
The notion of personal data (or data of a personal nature) designates any information relating to a physical person who can be identified directly or indirectly.
1.1 Registration. Consultation and use of the PlayFetish.com service require your registration. To be able to consult and use our services (including the creation of your personal space), you must be 18 years of age or older, register to create an account and accept the ToS and the Charter. If you do not wish to complete the registration form, you will not be able to use the services offered by PlayFetish.com.
By registering on the PlayFetish.com service, you undertake to comply with the provisions of the General Data Protection Regulation No. 2016/679 (hereinafter, the "GDPR") and French law, the violation of which is punishable by criminal sanctions.
Registration on PlayFetish.com is subject to an age validation procedure. This validation is carried out via a third-party site (Yoti or any other site offering similar services). This age validation service requires you to take a photo of yourself at the time of the procedure. Presentation of an older photo, a video or a deepfake is prohibited and will block validation. The validation service then confirms whether you are an adult – you can then register on PlayFetish.com, or a minor – and your registration on PlayFetish.com is blocked. We do not collect any personal data relating to the age validation procedure (apart from the date of birth, collected during registration). Yoti, or any other site offering similar services, only collects your photo for the purpose of age validation. This is destroyed once the validation is carried out, in accordance with Yoti's personal data protection policy.
1.2 Data Collected. In accordance with the provisions of the GDPR, in application of the principle of data minimization, we only collect data strictly necessary for the use and operation of the PlayFetish.com service.

You can also communicate other personal data concerning you (such as photos and videos) to complete your profile or in the context of your exchanges with other Users of the PlayFetish.com service. This data is freely communicated and must at all times comply with the terms of use of the PlayFetish.com service and this Charter.
- Geolocation
Geolocation allowing to determine the location of Users through a mobile phone. The purpose of this geolocation service is the connection of Users. The system uses personal data (phone number, etc.), and therefore also involves processing personal data. Geolocation can be activated if you wish, and deactivated by going to the settings of your device (computer, tablet or mobile phone) or browser.
1.3 Purposes of Processing. Your personal data is processed mainly for the following purposes:
● registration management,
● management of your personal account (User profile),
● geolocation,
● use of services by the User,
● purchase of services on PlayFetish.com,
● management of problems with Users and User disputes.
Deus Communication does not transfer your personal data to third parties for marketing or commercial purposes.
1.4 Legal Bases for Data Collection and Processing. The collection and processing of your personal data are based on consent during your registration on PlayFetish.com.
The use of your personal data can also be based on the protection of our legitimate interests related to the provision and use of the service, and to ensure compliance with a legal or regulatory obligation, such as:
● management of the relationship with Users;
● security of personal data (e.g., preventing digital identity theft);
● resolution of any dispute or litigation or resolution of a problem related to the use of PlayFetish.com;
● responding to requests in the context of law enforcement investigations (e.g., judicial requisitions) or judicial proceedings;
● improving the quality of our services (e.g., measuring traffic to PlayFetish.com).
1.5 Data Protection Impact Assessment. We have carried out an impact assessment on the protection of data collected in the context of the use of PlayFetish.com. The impact assessment (DPIA or Data Privacy Impact Assessment) demonstrates the compliance of data processing with the GDPR, in particular respect for the privacy of Users when processing is likely to generate high risks for the rights and freedoms of the persons concerned (such as the collection of sensitive data). Personal data is collected by the company Deus Communication, operator of the PlayFetish.com service. The recipients of your personal data are the services of Deus Communication to allow the provision of the service.
You recognize and accept that your data may be transmitted to third-party subcontractors involved in the provision of the PlayFetish.com service and/or the sections or services offered on PlayFetish.com, such as payment services for the purchase of paid services on PlayFetish.com or our technical host for data storage. It is specified that the technical host is located in France or in the European Union, and that it is also subject to compliance with the GDPR.
3.1 Definition and Purpose of Cookies. During your visits to PlayFetish.com, "cookies" may be automatically installed on your browser software and are read when you connect to the PlayFetish.com site. 6.2 Right to Portability. The right to portability allows you to recover part of your data to store or transmit them easily from one information system to another, with a view to their reuse for personal purposes. The data concerned includes your personal data communicated during your registration and the data generated during use of the PlayFetish.com service (photos, videos). You can recover your data by sending an email to [email protected]. Deus Communication will ask you to communicate your nickname and the name of the site, with a copy of an identity document for identification. We only keep this document for authentication purposes and destroy it as soon as this has been carried out. Deus Communication will send you files by email allowing you to access the data.
6.3 Data Deletion. You can close your account and request the deletion of your data at any time, as specified in article 8 below.
Deus Communication keeps your data for the duration necessary for the operations for which they were collected. Furthermore, we keep certain categories of data that could be necessary in case of a complaint, subsequent litigation or judicial investigation.

You can close your account at any time from your personal account. During this procedure, you can opt for the definitive deletion of your account, or for temporary suspension, with the possibility of reactivating the account for a period of 24 months. In this case, if you decide to reactivate your account within this period, most of your data (notably, photos, videos) can be put back online on your profile.
Upon closure of your account, your data will be deactivated and no longer accessible online. It will be destroyed in accordance with the data retention period rules, as specified in the previous article.

Deus Communication has designated a data protection officer (DPO).
